{"id":55,"date":"2021-01-27T05:41:21","date_gmt":"2021-01-27T05:41:21","guid":{"rendered":"http:\/\/192.168.1.253\/wordpress\/?page_id=55"},"modified":"2021-09-23T19:45:51","modified_gmt":"2021-09-23T19:45:51","slug":"chapter-3-preliminary-thoughts","status":"publish","type":"page","link":"https:\/\/unstablefocus.mynetgear.com\/?page_id=55","title":{"rendered":"Chapter AC:  Preliminary Thoughts"},"content":{"rendered":"\r\n<p>Before reading the rest of this book and thinking, \u201cHe\u2019s just a bitter, abusive man who is angry because he got caught,\u201d please allow me to preface what is to come. First, I have never intentionally hurt anyone in my life.\u00a0 I have never struck anyone to hurt them.\u00a0 Like anyone else, I sometimes get angry, but I really don&#8217;t think I have an anger management issue. \u00a0I can only recall getting extremely angry a handful of times in my life and never at an immediate family member besides the time Rita refused to allow me to see my children.<\/p>\r\n<p>While I know for a fact that I&#8217;ve never abused anyone physically or verbally, there are, of course, <em>many<\/em> other ways a person can be abusive. \u00a0All I can say about other forms of abuse is that I have never intended to abuse anyone in any way. \u00a0I can&#8217;t control how other people feel or think, but it has never been my intent to make anyone, especially a family member, feel bad or abused.\u00a0 I have seen people be emotionally abused and\/or financially trapped in a relationship they would like to end. \u00a0I also see how people wind up staying in these relationships. \u00a0In the end, I feel abuse basically comes down to trapping someone such that they feel it&#8217;s better to stay and be abused than to leave.<\/p>\r\n<p>I can certainly see how Rita may have felt financially trapped in our marriage because she had become accustomed to a standard of living that she alone could not provide. \u00a0This isn&#8217;t something I ever wanted or tried to make happen. \u00a0I tried to get Rita to take classes or learn a trade for many years. \u00a0I took an accounting class at a community college with her while I was in graduate school because she wouldn&#8217;t take it alone. \u00a0Unfortunately, there were not many adult education opportunities around State College, but we did look into what it would take for Rita to become an LPN or a nursing assistant. \u00a0I was hoping the shoe store we ran for several years would become something she could call her own and be proud of. \u00a0Unfortunately, we didn&#8217;t foresee people buying children&#8217;s shoes online without trying them on.<\/p>\r\n<p>I will allow you to decide if I&#8217;m a misogynist. I don&#8217;t think I am, and I don&#8217;t feel any animosity towards any particular group of people, including women. Sure there are some women that I don&#8217;t like, and you\u2019ll read about them shortly.\u00a0 But I would say the percentage of women I dislike is probably much less than the percentage of men I dislike, both being tiny percentages.\u00a0 Although it may seem like I am blaming women for what happened, that is really just a coincidence as my ex-wife is a woman; her two attorneys were women, my three attorneys were women, and two of the four judges were women.\u00a0 Besides choosing women for my attorneys, I had no control over the other women involved.\u00a0 And I honestly really don\u2019t blame them for what happens, besides maybe one of the judges.<\/p>\r\n<p>I also do not blame drugs or alcohol for what happened.\u00a0 I have never used any illegal drugs, abused prescription drugs, or drunk enough alcohol to be considered drunk more than a handful of times.\u00a0 I dislike the taste of beer.\u00a0 Yes, all beer, even \u201cgood\u201d beer.\u00a0 When I drink alcohol, I get extremely sleepy, and I will sometimes drink a glass of wine or a bottle of hard cider if I\u2019ve been having trouble sleeping.<!--nextpage-->So who do I blame for what happened?\u00a0 Well, I certainly didn\u2019t help myself by being naive, an over-active worrier, not knowing how to behave when being accused of something, seeming arrogant, letting my frustration get the best of me at times, and having little respect for a legal system I came to view as seriously flawed. There are certainly specific things I would do or handle differently with the knowledge I have now. \u00a0However, I know everything I did was with good intent and in my children&#8217;s best interest. \u00a0I suppose the thing I regret the most that had long-term consequences is not being more careful about what was on the scraps of paper I sent the kids for an origami project that was essentially the last stake in the heart of my former life. \u00a0I will obviously discuss this in much greater depth later in the book.<\/p>\r\n<p>If I were forced to blame a person besides myself, I would have to say I blame Judge Pam Ruest the most. She is the one that issued a seriously flawed protective order without even taking the time to read it.\u00a0 Then she sentenced me to 30 days in jail and six months of probation for doing things she acknowledged she should have allowed.\u00a0 She never seemed to believe anything I said.\u00a0 This was extremely frustrating because never in my life before this had I had people assume I was lying.\u00a0 And it seemed like the harder I tried to get her to believe me, the more she did not.\u00a0 A different judge ultimately replaced her because the district attorney was suing her. Thus, she had a conflict that would have worked to my advantage on cases presented by the district attorney\u2019s office.\u00a0 I also got her removed from the civil (custody\/support) cases.<\/p>\r\n<p>One of Pam\u2019s problems in handling custody matters is that she does not have kids.\u00a0 Some of the orders she issued just made no sense from a practical standpoint.\u00a0 For example, she thought it was a good compromise to allow my kids to move to Dundee, Michigan, and have Rita bring them back to State College, Pennsylvania, twice a month.\u00a0 I certainly did not ask for this and had no idea how she thought this arrangement could work.\u00a0 First, where was Rita going to stay for the weekend?\u00a0 Did Pam expect her to pay for a hotel every two weeks, especially when hotel rooms in State College are costly or simply not available on weekends when there is a Penn State home football game, during graduation, etc.?\u00a0 Did Pam expect my kids to be happy about spending 13 hours in a car every two weeks to visit their father?\u00a0 Ultimately, they would blame me for making them do this, and they would resent me for it.\u00a0 It made no sense on many levels, and the first thing Rita did when she had to obey the order was to ignore it and file a motion to have it changed.\u00a0 At this point, what was Pam going to do?\u00a0 Force Rita to move back to State College, where she had no place to live? \u00a0Maybe Pam is smarter than I think, and this is what she expected to happen the entire time, and this final order she issued was just another way to punish me.<\/p>\r\n<div class=\"su-box su-box-style-default\" id=\"right-sidebar\" style=\"border-color:#000009;border-radius:3px;max-width:none\"><div class=\"su-box-title\" style=\"background-color:#2F323C;color:#FFFFFF;border-top-left-radius:1px;border-top-right-radius:1px\">The Job of a Judge<\/div><div class=\"su-box-content su-u-clearfix su-u-trim\" style=\"border-bottom-left-radius:1px;border-bottom-right-radius:1px\">Judge Pamela Ruest provided some statistics on domestic violence in the state, saying that since 2004, 1,678 people have died as a result of domestic violence \u2014 including women, men and children.<br \/>In 2013, she said, a total of 158 died, including 107 victims and 51 perpetrators who either killed themselves or were killed during apprehension. In 2014, that number dipped slightly, with 141 deaths \u2014 97 victims and 44 perpetrators.<br \/>No deaths in either of those years took place in Centre County, she said, but that has changed.<br \/>\u201cOur work won\u2019t be finished until that number is zero,\u201d she said.<\/div><\/div>\r\n<p>One of the things that bothered me most about Pam Ruest is when she stood in the courthouse in October, Domestic Violence Awareness Month, of 2015 during a rally against domestic abuse, and said, as reported by the <a href=\"https:\/\/www.centredaily.com\/news\/article44728077\">Centre Daily Times<\/a>, \u201cOur work won\u2019t be finished until that number [the number of people harmed in domestic violence incidents] is zero!\u201d\u00a0 An excerpt from the article is contained in the sidebar.\u00a0 It doesn\u2019t seem like she received any backlash from this, and why would she?\u00a0 It seems like a very noble statement.\u00a0 However, she is a <em>judge<\/em>, not a district attorney.\u00a0 Preventing domestic abuse is not her job, and I feel the Judicial Conduct Board should have taken some disciplinary action against her for this.\u00a0<\/p>\r\n<p>While I don&#8217;t know if she truly feels this way, I can certainly see why she said what she did.\u00a0 Remember, judges are elected officials and need to say politically correct things to ensure reelection.\u00a0 Judges are both lawyers <em>and<\/em> politicians in this country.\u00a0 HBO\u2019s Last Week Tonight with John Oliver had a great segment on this that is now on <a href=\"https:\/\/www.youtube.com\/watch?v=poL7l-Uk3I8\">YouTube<\/a>.\u00a0 I would <em>very <\/em>much encourage you to watch it, as it\u2019s hilarious, and I think it says a lot about our judicial system.\u00a0 Lawyers and politicians are two of the most hated groups of people, yet judges are probably one of the most respected.<\/p>\r\n<p>Another person I think deserves some blame is Jonathon Grine, the judge that took over for Ruest.\u00a0 He seemed extremely arrogant and simply not very intelligent.\u00a0 More reasons for thinking this will become clear as I talk about how he handled things.\u00a0 He was later \u201ccounseled\u201d (i.e., reprimanded) by the Judicial Conduct Board for having an \u201cinappropriate\u201d relationship with the district attorney, who I believe actually wrote some of the opinions he issued.\u00a0 The final judge on the case, Katie Oliver, seemed very reasonable and fair.\u00a0 I wish she\u2019d been the judge from the start.<!--nextpage-->My attorneys think Rita\u2019s lawyers, Laura Robbins and then Tonia Torquato, are the people I should blame for setting everything in motion. \u00a0Laura didn&#8217;t represent Rita for very long, but I believe she is the one that talked Rita into using a protective order to get what she wanted. \u00a0Tonia was going through her own messy divorce at the time (the petitions for a protective order she filed against her estranged husband can be found here**) and had been reprimand by her law firm for having an intimate relationship with one of her clients whose estranged wife had a protective order against him.\u00a0 My attorneys feel she should not have been involved in divorce and custody cases during this time because she could not remain objective and seemed to take her anger out in the courtroom.\u00a0 I think she burned a lot of bridges with other divorce attorneys.\u00a0 I know she did with one of my attorneys as she frequently reneged on verbal agreements they had made.\u00a0 In my opinion, she was doing her job, maybe with a bit too much zeal, but she got Rita what she wanted.<\/p>\r\n<p>I blame Pennsylvania&#8217;s legal system the most, particularly its system for trying to prevent domestic abuse\/violence. \u00a0That being said, the men who have abused and continue to abuse their families are the fundamental problem. \u00a0The system we have is a direct result of these terrible people.<\/p>\r\n<p><!--nextpage-->I understand domestic abuse is a serious problem and really wish this book offered some groundbreaking solution to deal with it.\u00a0 I\u2019ve spent a <em>lot<\/em> of time thinking about it over the past eight years and have not developed any good ideas. \u00a0I will offer suggestions for changes that might improve things, but this book is not about reforming domestic abuse laws; I want to tell my story.\u00a0<\/p>\r\n<p>It is, of course, a noble effort to prevent domestic abuse and crime in general, just like it is a noble effort to prevent terrorism, mass shootings, and disease.\u00a0 The problem is that as you go from disease to terrorism to mass shootings to smaller crimes, you wind up having more and more innocent people affected.\u00a0 I do not see many adverse effects from trying to prevent disease, although the anti-vaxxers will argue that some of the ways we do that are worse than the diseases themselves, etc.\u00a0 In trying to prevent terrorism, innocent people have given up many freedoms they may or may not care about.\u00a0 Some innocent people have been adversely affected greatly; innocent people have been accused of being terrorists, put on no-fly lists, etc. \u00a0Many more people have been inconvenienced repeatedly by restrictions on flying, travel, etc.<\/p>\r\n<p>The problem really comes when you try to prevent violent crimes or crime in general.\u00a0 This requires predicting human behavior when people often cannot even predict what they themselves are going to do.\u00a0 I believe, as most people do that predicting future behavior is best done by looking at past behavior.\u00a0 However, if someone gets \u201clabeled,\u201d it\u2019s tough to overcome.\u00a0 The behaviors that lead to this label may have been very situational, and even the most righteous person would have behaved the same way in the same situation.\u00a0 This is a phenomenon called the fundamental attribution error in social psychology.\u00a0 The Wikipedia <a href=\"https:\/\/en.wikipedia.org\/wiki\/Fundamental_attribution_error\">page<\/a> describes it as \u201c&#8230;the tendency for people to under-emphasize situational explanations for an individual\u2019s observed behavior while over-emphasizing dispositional and personality-based explanations for their behavior.\u00a0 This effect has been described as \u2018the tendency to believe that what people do reflects who they are.\u2019\u201d \u00a0There are two great podcasts from Stuff You Should Know titled, <span data-test=\"truncate-span\"><a href=\"https:\/\/www.iheart.com\/podcast\/stuff-to-blow-your-mind-21123915\/episode\/the-fallacy-of-alignment-fundamental-attribution-30907739\/\">The Fallacy of Alignment: Fundamental Attribution Error<\/a>, Part I\/II, that offer a great discussion of this. I bring this up because I feel much of what ails society today, the tribal and &#8220;us versus them&#8221; attitude, can be blamed on this. Ultimately, it establishes that we aren&#8217;t really all that different, but the circumstances of our lives can be <em>extremely<\/em> different.<\/span><\/p>\r\n<p><span data-test=\"truncate-span\">P<\/span>reventing crime and, in particular, domestic abuse and violent crimes can have some seriously adverse and unintended consequences, and systems and people can easily go too far.\u00a0 It\u2019s never politically <em>incorrect<\/em> to say that you want to prevent violent crimes or domestic abuse, as it is rarely politically <em>correct<\/em> to say you want to repeal laws that have been enacted to do just that.\u00a0 It\u2019s just that most people have never committed or been accused of a crime, so they think only the \u201cbad\u201d people will be affected by overreaching laws.\u00a0 I was certainly one of these people for most of my life.<\/p>\r\n<p><!--nextpage--><\/p>\r\n<div id=\"attachment_343\" style=\"width: 259px\" class=\"wp-caption alignleft\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-343\" class=\"wp-image-343 size-medium\" src=\"https:\/\/unstablefocus.mynetgear.com\/wp-content\/uploads\/2021\/02\/Al-249x300.jpg\" alt=\"\" width=\"249\" height=\"300\" srcset=\"https:\/\/unstablefocus.mynetgear.com\/wp-content\/uploads\/2021\/02\/Al-249x300.jpg 249w, https:\/\/unstablefocus.mynetgear.com\/wp-content\/uploads\/2021\/02\/Al-849x1024.jpg 849w, https:\/\/unstablefocus.mynetgear.com\/wp-content\/uploads\/2021\/02\/Al-768x926.jpg 768w, https:\/\/unstablefocus.mynetgear.com\/wp-content\/uploads\/2021\/02\/Al.jpg 1067w\" sizes=\"auto, (max-width: 249px) 100vw, 249px\" \/><p id=\"caption-attachment-343\" class=\"wp-caption-text\">Al Kudlach outside the Centre County Courthouse.<\/p><\/div>\r\n<p>I am very aware of how difficult it is to determine who might resort to violence against a domestic partner.\u00a0 I spent many months in the same cell block as two men who had been accused (and then convicted) of murdering their wives; they were waiting for their trials at the time.\u00a0 One was <a href=\"http:\/\/www.statecollege.com\/news\/local-news\/husband-faces-murder-charges-for-allegedly-shooting-wife,1465242\/\">Alois Kudlach<\/a>, who was convicted of shooting his wife three times, killing her, in their home in an affluent neighborhood of State College.\u00a0 The other was <a href=\"https:\/\/www.centredaily.com\/news\/local\/crime\/article103845236.html\">Vladimir Podnebennyy<\/a>, who, a month later, stabbed his wife and killed her in the parking lot outside their home.\u00a0 Besides Al being arrogant, these seemed like two very normal guys.\u00a0 They were, in fact, the block \u201ctrustees\u201d who helped the guards serve food, did the block\u2019s laundry and cleaned the block&#8217;s common areas after everyone was locked in their cell for the night.\u00a0 No one could believe the friendly old man (Vlad) that didn\u2019t speak English was the guy that had stabbed his wife.<\/p>\r\n<div id=\"attachment_344\" style=\"width: 235px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-344\" class=\"size-medium wp-image-344\" src=\"https:\/\/unstablefocus.mynetgear.com\/wp-content\/uploads\/2021\/02\/Vlad-225x300.jpg\" alt=\"\" width=\"225\" height=\"300\" srcset=\"https:\/\/unstablefocus.mynetgear.com\/wp-content\/uploads\/2021\/02\/Vlad-225x300.jpg 225w, https:\/\/unstablefocus.mynetgear.com\/wp-content\/uploads\/2021\/02\/Vlad-768x1023.jpg 768w, https:\/\/unstablefocus.mynetgear.com\/wp-content\/uploads\/2021\/02\/Vlad-1153x1536.jpg 1153w, https:\/\/unstablefocus.mynetgear.com\/wp-content\/uploads\/2021\/02\/Vlad.jpg 1263w\" sizes=\"auto, (max-width: 225px) 100vw, 225px\" \/><p id=\"caption-attachment-344\" class=\"wp-caption-text\">Vlad Podnebennyy outside the Centre County Courthouse.<\/p><\/div>\r\n<p>Of course, it would have been great to prevent these murders, but I don&#8217;t know how you could have predicted them. \u00a0I believe Vlad had a PFA order against him, but I don&#8217;t know the circumstances surrounding it. I don&#8217;t think either of them had any history of violent behavior; at least none was reported in the media, and they did not seem to have anger issues. \u00a0That said, as I&#8217;ll probably say again, people in jail are not drunk or high, and you never really how drugs and\/or alcohol affect a person&#8217;s demeanor. I know that every story I heard in jail or in the domestic violence classes I had to take involved at least one of the participants being under the influence of something. \u00a0Most of the time, both parties were. \u00a0<\/p>\r\n<p>The other problem is that the effect of preventative measures is, almost by definition, impossible to measure accurately. You will never have a blind control group with which to compare. \u00a0This was very clear during the COVID-19 pandemic, as we really have no idea which measures&#8211;masks, quarantines, shutdowns, etc.&#8211;helped the most, or at all. \u00a0It&#8217;s the same with measures to prevent domestic abuse, and in particular, domestic violence. \u00a0I will talk about this a great deal later because, as far as I can tell, there has been no real study of how or if Pennsylvania&#8217;s Protection from Abuse Act has improved anything. \u00a0In fact, it seems like there is actually hesitancy to do these kinds of studies because I think there&#8217;s a fear that they will show the situation has not improved much, or at all.<!--nextpage-->What I truly believe lead to this mess is Rita\u2019s (and her mother\u2019s and sister\u2019s) disposition to being paranoid about things.\u00a0 I am not saying that they are delusional, but I think they tend to believe that other people are out to get them.\u00a0 The funny thing is, I have also recently been accused of being paranoid because of the events that occurred over the last eight years.\u00a0 And, in fact, my paranoia grew considerably for a period of time but has since subsided.\u00a0 This was because I had no idea what Rita might accuse me of next.\u00a0 I spent many years dreading when the phone would ring because I thought it might be the police.\u00a0 This was especially true if caller-ID was showing a blocked number. There were many occasions, not all of which I lead to arrests, that I picked up the phone and a police officer said, \u201cDo you know why we\u2019re calling?\u201d\u00a0 Almost every time, I had no idea why they were calling, but I would soon learn that I had been accused of something.<\/p>\r\n<p>Ultimately, I believe Rita truly came to think I was out to get her and was afraid of me. I was <em>not<\/em> out to get her and did not want her to be afraid of me. Her fear certainly must have affected the kids, and I don\u2019t want any kid living with a mother who is afraid of their father. While my attorneys kept telling me this, it took me a long time to accept. What my attorneys didn\u2019t see was how Rita acted when she was around me. She certainly did not appear to be afraid of me, and in fact, we regularly talked during custody exchanges. I can only recall one exchange in which there was a disagreement. This was when Rita kept insisting that I hated her in front of the kids.\u00a0 I kept telling her that wasn\u2019t true, and it was not.\u00a0 I finally said, \u201cI don\u2019t hate you, but you had an affair, and I don\u2019t particularly like that you did that.\u201d The kids were in the car by this time, and they didn\u2019t hear me. Rita responded, \u201cDon\u2019t let the kids hear that, or they\u2019ll hate me.\u201d<\/p>\r\n<p>The fundamental problem was that all of these accusations had to be conveyed through attorneys and\/or the police.\u00a0 A protective order did not allow me to talk to her, and whenever we did talk, the kids were around.\u00a0 Thus, instead of asking me if I was driving by her house because she thought she <em>heard<\/em> my car, she told the police, who often didn\u2019t even make me aware of the allegation.\u00a0 Had she asked me, I would have told her that I had never driven by her house and possibly provided some evidence that I had not.\u00a0 I\u2019m not sure if she would have believed me, but at least I could have defended myself and hopefully put her mind at ease.\u00a0 Thus, I think the paranoia grew unchecked, with her mom, sister, attorney, and police feeding it.<\/p>\r\n<p>I realize now that not communicating is a huge problem with protective orders, especially when children are involved.\u00a0 I can certainly understand why this is part of most protective orders, as no one wants someone making threats.\u00a0 However, the courts have obviously realized that not communicating is a serious problem when the order involves parents with children.\u00a0 This is why they regularly include clauses in orders that say the parents can communicate via text message if it concerns the children.\u00a0 Why this was not in my original protective order is something that has never been explained to me.\u00a0 However, knowing that Pam Ruest just signed the order without reading it, I suspect that it was provided by the attorney representing Rita and was thus made as restrictive as possible.\u00a0 Had a clause like that been in the original order, I believe things would have turned out much differently, and I would not be writing this book.<\/p>\r\n<p>My suggestion for how a court could allow the parties involved to communicate without the fear of one party threatening the other is to have the communication go through a designated third party or possibly multiple parties.\u00a0 This could be someone or people agreed upon by the parties or someone assigned by the court, such as a mediator.\u00a0 Additionally, I think the court should require counseling with both parties present.\u00a0 I wound up going through two domestic violence prevention programs and what became clear is that where there actually was abuse, it usually went both ways. Almost always, drugs or alcohol were involved.\u00a0 Thus, having both parties there would allow them each to tell their story.\u00a0 In fact, a female group leader with the second program would frequently say, \u201cYou know.\u00a0 Women are psycho.\u201d\u00a0 When I told her I didn\u2019t think that was appropriate because the women involved were likely people we either loved or still love, she got angry. A new person eventually replaced her.<\/p>\r\n<p>While I understand the courts would like to avoid further conflict between the parties and having joint programs could become volatile, I think it would be doable.\u00a0 Most of the men I encountered during these programs did not seem violent and, for the most part, seemed sober.\u00a0 In fact, I think that if something did get out of hand in a joint program, the other people there would quickly put a stop to it.\u00a0 In fact, on one occasion, I got into a pretty heated argument with another member when, after the group was making fun of the crazy cults on reality TV, I said, \u201cWhy do you assume all cults are bad and people joining them are crazy?\u00a0 By definition, all religions are cults.\u201d\u00a0 Before I could explain that I don\u2019t think religions are necessarily bad, another group member nearly jumps out of his chair at me.\u00a0 This was probably the only time I felt somewhat threatened, even counting when I was in prison.\u00a0 The other group members and the leaders got him settled down.<\/p>\r\n<p>You would obviously have to have staggered arrivals and departures so that the parties did not encounter one another before or after the meeting.\u00a0 However, this is done during supervised visits when there is a protective order in place between the parents.\u00a0 That seems to work well.\u00a0 Plus, domestic violence incidents rarely occur in public, and if they do, it is unlikely that anyone could have prevented it.\u00a0 I suppose you might also try to make sure there are no weapons by having the meetings at a secure location like a courthouse or state-owned building.\u00a0 This, of course, wouldn\u2019t prevent someone from having a weapon in their vehicle.\u00a0 However, my thinking is that if someone wants to hurt someone badly enough, they will find a way to do it.<!--nextpage--><\/p>\r\n\r\n\r\n\r\n<p><span data-tt=\"{&quot;paragraphStyle&quot;:{&quot;alignment&quot;:0,&quot;writingDirection&quot;:1}}\">I have drafted many letters to the kids trying to figure out how to explain my side of the story without being too critical of their mother. I never sent any of these letters as I thought they would likely do more harm than good. A large part of writing this book is so they can understand what happened and know that I was never \u201cout to get\u201d their mother, nor had I ever abused her, harassed her, or stalked her. It was tough for me not to come out and tell them everything that happened. I so desperately wanted to defend myself. But I thought it would simply backfire, and they would think even worse of me. In hindsight, I think it was the right thing to do.
